In this privacy policy, Fontaine Engineering und Maschinen GmbH, Industriestrasse 28, 40764 Langenfeld (hereinafter “we” or “us”) would like to inform you how we, as the person responsible in terms of data protection law, process personal data about you during your visit to our website www.foen-gmbh.de.
1. What personal data do we collect from you?
Personal data is all information about a specific or identifiable natural person that you provide to us or that is created by us or collected by us. With regard to our website, these include in particular:
Inquiry data: On our website, we offer you various options to contact us via inquiries. If you use the contact form provided for this purpose, data will be entered by you or collected about you in this context. This is done in particular in the following cases:
If you send us a general or specific request via the contact form or email addresses specified on our website, we will process the data provided therein to process your request.
Server log data: When you use our websites, data (such as the date and time of your visit, pages viewed and files requested, type and version of the web browser you use, type and operating system of the terminal device you use, and your IP address) is temporarily stored in a log file.
2. What do we process your personal data for, on which legal basis and for how long?
2.1 Your inquiries
If you send us inquiries via a contact form or by e-mail, we process the information you provide in it to answer your request as well as the IP address and date/time of the request to prevent misuse of the contact form.
The legal basis for processing is our legitimate interest in accordance with Art. 6 (1) lit. f GDPR to provide you with the requested service (e.g. supplier portal, TECAdemy, contact request). If your request is aimed at initiating or processing (including customer service or warranty) of a contract, the additional legal basis for processing is Art. 6 (1) lit. b GDPR.
You can object to the processing of your data on the basis of Art. 6 (1) lit. f DSGVO. We can then continue processing if there are compelling reasons for processing. In this case, this may be necessary in particular to be able to prove past communication and inquiries with you. If there are no such compelling reasons, we will stop communicating with you and delete data that has already been collected.
This data is deleted when our communication with you or the connection with you resulting from your request has ended, i.e. when the matter in question has been finally clarified and there are no further legitimate interests to store it or there are no further legal obligations to store it.
2.2 Advertising and product development (usage data, etc.), right of objection
We would also like to use the data you have already entered or generated when you use the websites to inform you about our products and services relating to our range of products (“services”) (advertising) or to improve our offers and services (product development).
2.2.1 Anonymized usage data
In doing so, we use anonymized or aggregated data to understand the surfing behavior of all visitors and thus improve the design of our website and our range of products in general.
2.2.2 Personalized or pseudonymized usage data
We also use your usage data to understand your surfing behavior and thus improve the offer shown to you or to display information tailored to you.
2.3 To provide the website and provide the services
The processing of server log data is necessary to provide the websites and to provide the services for technical reasons and then to ensure system security.
The legal basis for processing is our legitimate interest in providing the website with our services (Art. 6 (1) lit. f DSGVO). Processing is absolutely necessary for the use of our website, so there is no right of objection.
This data will be deleted after 14 days at the latest.
The server log data may then be analysed anonymously for statistical purposes and to improve the quality of our website. The server log data will not be linked to your personal data or the server log data will not be combined with other personal data sources.
3. Transfer of data
3.1 Transfer of data to contract processors
In some cases, we use service providers in compliance with legal requirements by way of order processing, i.e. on the basis of a contract on our behalf, in accordance with our instructions and under our control.
Contract processors are in particular
technical service providers that we use to provide the website, e.g. service providers for software maintenance, data center operation and hosting.
technical service providers that we use to provide functionalities, e.g. technically necessary cookies.
Service providers for the practical implementation of advertising and marketing, e.g. service providers for email delivery.
In these cases, we remain responsible for data processing; the transfer and processing of personal data to or by our contract processors is based on the legal basis that allows us to process data in each case. A separate legal basis is not required.
3.2 Transfer of data to third parties
In some cases, we also transfer your data to third parties, i.e. partners with whom we work outside of order processing. Such partners provide their services as their own controllers; only their data protection notices apply to the processing of your data by partners.
3.2.1 Logistics companies
To transport material, etc. that you have ordered, we will transfer your address and contact details, if necessary, to parcel transport companies. The legal basis for the transfer is the execution of the contract with you, Art. 6 (1) lit. b GDPR.
3.2.2 Social networks
If you want to share one of our websites on a social network (e.g. Facebook or Twitter) and click on one of our “share” buttons, this information is transmitted to the social network. This requires that you are logged into the social network. The legal basis for the transfer is our legitimate interest in offering you the opportunity to “share”, Art. 6 (1) lit. f DSGVO.
4. Cookies
4.1 What are cookies?
In order to make our websites as user-friendly as possible, we use so-called “cookies.” Cookies are small files that are stored on a visitor's hard drive. They make it possible to store information over a certain period of time and to identify the visitor's computer. This is partly done using so-called tracking pixels, which are not stored on a visitor's hard drive but can help identify the computer in the same way as a cookie. In the following, the term “cookie” includes cookies in the technical sense as well as tracking pixels and similar technical methods.
4.2 Which cookies do we use on which legal basis and for how long?
We use a category of cookies on our websites: Technically necessary cookies, without which the functionality of our websites would be limited. These cookies are essential to enable you to move around our websites and use their functions. They allow you to easily search for retailers where you can buy our products (e.g. by displaying a map of your area), save your language settings or your consent or rejection of cookies. These cookies do not collect information about you that should be used for marketing purposes or that save where you have been on the Internet. Deactivating this category of cookies would restrict the functions of the websites in whole or in part. The legal basis for processing is our legitimate interests (Art. 6 (1) lit. f GDPR). These cookies are session-specific and expire after your visit to the website (session).
4.3 How do I disable cookies?
You can specifically deactivate individual cookies using the links in the table above (objection options, opt-out). Finally, you can also prevent the use of any cookies by making appropriate cookie settings in your browser. However, we would like to point out that the functionality of our websites will be limited in this case even if technically necessary cookies are blocked.
For example, you can read more about cookies and the individual providers on the website www.youronlinechoices.com. There, too, you have the option of objecting to usage-based online advertising using individual or all tools. To go directly to the preference manager, please click here http://www.youronlinechoices.com/de/praferenzmanagement.
5. Links
We use links to other websites of ours on third-party websites and services, e.g. on social media channels such as Facebook, Twitter or YouTube. Only these third parties are responsible for data processing by such other service providers on their websites and their privacy policies apply.
6. Safety
We and our service providers take technical and organizational security measures to protect your personal data managed by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our data processing and security measures are constantly being improved in line with technological developments.
When your personal data is transmitted to us, it is encrypted using Secure Socket Layer (SSL). Personal data that is exchanged between you and us or other participating companies is generally transmitted via encrypted connections that are state of the art.
Our employees and our contracted service providers are, of course, committed to confidentiality.
7. Your rights to information, correction, blocking or deletion
Every natural person whose personal data we process has the following rights against us in principle (i.e. depending on the respective requirements):
If you have any questions about the processing of your personal data by us, we will be happy to provide you with information about the data stored about you free of charge at any time (Art. 15 GDPR).
You have the right to correct and complete incomplete data (Art. 16 GDPR).
You have the right to block/restrict the processing or deletion of your personal data that is no longer required or stored due to legal obligations (Ar.t 17, 18 GDPR).
You have the right to transfer the data in a structured, common and machine-readable format, provided that you have provided us with the data based on consent or on the basis of a contract between us and you (Article 20 GDPR).
You have the right to object to the processing of your data for direct marketing at any time (see also Article 21 (2) and (3) GDPR)).
You have the right to object based on processing based on a legitimate interest, and we can then explain our compelling reasons (Article 21 (1) GDPR). We have pointed out above (see paragraph 2) when this right exists.
If you have given your consent to data processing, you can revoke this at any time with effect for the future, i.e. the lawfulness of data processing up to the time of revocation remains unaffected. After withdrawing your consent, you may no longer be able to use our services.
Please send your request in writing (keyword: data protection) or by e-mail to the contact details given in section 8. We reserve the right to verify your identity so that your personal data does not become known to unauthorised persons.
You also have the right to lodge a complaint with a supervisory authority for data protection.
8. Data protection officer
Please contact us and send your request in writing to Fontaine Engineering und Maschinen GmbH, Industriestr. 28, 40764 Langenfeld, Germany with the note “Data Protection” or send us an e-mail to info@foen-gmbh.de.
