Fontaine Engineering und Maschinen GmbH (hereinafter “we”, “us” or “Fontaine Engineering und Maschinen GmbH”) takes the protection of your personal data very seriously. With the following data protection information, we inform you about the processing of your personal data as part of Fontaine Engineering und Maschinen GmbH's recruitment and application process and about your data protection rights so that you know when we collect which personal data and how we use it. Your personal data is processed in accordance with applicable data protection law, in particular the provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG)

1. Who is responsible for processing my data?
Fontaine Engineering und Maschinen GmbH is responsible for all job advertisements and the processing of personal data in the application process.

2. What types of personal data do we process about you?
Personal data is any information about an identified or identifiable natural person in accordance with Article 4 (1) GDPR. When you apply to us, we process the following categories of personal data:

  • Master data and contact information, in particular first and last name, title, private address, e-mail address, telephone number (s)

  • Application documents (e.g. cover letter, curriculum vitae)

  • Qualification data (e.g. data on higher education, professional qualification)

  • Information about your previous and current job (s) (e.g. job title, place of work, department, position/function, tasks and projects, name of the manager, data on business trips, data on continuing education, start and end dates and, if applicable, reason for leaving)

  • Communication data (e.g. e-mail traffic, telephone connections)

  • Log data that is generated when using IT systems

  • Severe disability status, if applicable.

Special categories of personal data (information about racial and ethnic origin, political opinions, religious and ideological convictions, trade union membership, health or sexual orientation, genetic and biometric data) are not specifically requested or collected by us (with the exception of voluntary information about any severe disability). Accordingly, we ask you not to provide any information about the above circumstances as part of your application

3. For what purpose is the data processed (purpose of data processing), on which legal basis and for how long?
We process the information you provide from public sources such as the Internet or previous employers exclusively for the purpose of processing applications and carrying out the recruitment process.

The legal basis for processing is Article 6 (1) (b) GDPR (contract fulfilment). Data processing is necessary to decide whether to establish an employment relationship. Should an application process result in employment, your personal data will be included in your personnel file for the purpose of establishing and carrying out the employment relationship and stored there for the duration of your employment relationship. Otherwise, we store your personal data as long as it is necessary for the above purposes and delete the data of rejected applicants within 6 months of notification of the decision to apply.

In certain cases, we also process your data to protect our legitimate interest, insofar as this is necessary to carry out the application process, and to defend legal claims under the General Equal Treatment Act (AGG). In this context, we have a legitimate interest in processing your data for evidentiary purposes. The legal basis for processing is Article 6 (1) (f) GDPR (overriding legitimate interests). Processing is then carried out until these procedures have been completed.

We process voluntary information as part of your application (e.g. application photo) and voluntary inclusion in a pool of applicants for future job advertisements on the basis of your consent. The sending of voluntary information based on the voluntary notice provided by us includes your consent. The legal basis for processing is Article 6 (1) (a) GDPR and Section 26 (2) BDSG. Your personal data will be deleted after 12 months.

4. Who receives your data?
Within Fontaine Engineering und Maschinen GmbH, your application documents and personal data will only be made available on a need-to-know basis and to the extent necessary to the persons responsible for this and bodies involved in the application process (e.g. potential supervisors, human resources, department, employee representatives and, if applicable, the responsible representative body for severely disabled people).

In addition, certain third parties may receive your personal data in order to process this data under appropriate instructions, regardless of whether it is the parent company SMS group GmbH or external third parties or not (“contract processors”). In some cases, we use service providers as contract processors in compliance with legal requirements by way of order processing, i.e. on the basis of an order processing contract on our behalf, in accordance with our instructions and under our control. The transfer and processing of personal data to or by our contract processors is based on the legal basis that allows us to process data in each case. A separate legal basis for the respective processor is not required.

5. Your rights as a data subject (including information, correction, blocking or deletion)
As a data subject, you have the following rights:

  • If you have any questions about how we process your personal data, we will provide you with information about the personal data stored about you (Art. 15 GDPR).

  • You have the right to correct and complete incomplete personal data (Article 16 GDPR).

  • You have the right to block/restrict the processing or deletion of your personal data that is no longer required or stored due to legal obligations (Art. 17, 18 GDPR).

  • You have the right to transfer your personal data in a structured, common and machine-readable format, provided that you have provided us with the data based on consent or on the basis of a contract between us or the respective group company and you (Art. 20 GDPR).

  • You have the right to object to the processing of your data for direct marketing at any time (Article 21 (2) and (3) GDPR).

  • If your personal data is processed on the basis of Article 6 (1) (f) GDPR, you can object to this. We can then only continue processing if compelling reasons for processing are proven. If there are no such compelling reasons, we will stop processing this data and delete data that has already been collected (Article 21 (1) GDPR).

  • If you have consented to the processing of your personal data (see above), you can withdraw this at any time with effect for the future in order to prevent further processing for the future. The lawfulness of processing up to the time of revocation remains unaffected. If you withdraw your consent, we will no longer process your personal data unless another legal basis allows this. Once consent has been withdrawn, you may no longer be able to participate in procedures that depend on consent (e.g. pool of applicants).

  • You also have the right to lodge a complaint with a supervisory authority for data protection if you believe that the processing of personal data concerning you violates the GDPR or other laws (Art. 77 GDPR).
